26 LC 47 4321 House Resolution 2033 By: Representative Taylor of the 92nd A RESOLUTION Recognizing the importance of the Rockdale County Board of Commissioners in exercising1 their lawful authority; and for other purposes.2 WHEREAS, an Act to create the Rockdale County Water and Sewerage Authority (Ga. L.3 1995, p. 3994) provides that such authority shall be governed by a seven member board to4 be appointed by the Rockdale County Board of Commissioners; and5 WHEREAS, for a number of years the Rockdale County Board of Commissioners has failed6 to appoint members to the Rockdale County Water and Sewerage Au thority following the7 expiration of the terms of prior authority members; and8 WHEREAS, the failure to appoint new members has left certain se ats on the authority's9 board vacant and other seats occupied by holdover members for years beyond the expiration10 of their original terms; and11 WHEREAS, the failure to maintain a properly constituted board has created significant legal12 uncertainty regarding the validity of the authority's official actions and has exposed the13 authority and the county to potential legal liability; and14 H. R. 2033 - 1 - 26 LC 47 4321 WHEREAS, the citizens of Rockdale County, who depend upon the authority for essential15 water and sewerage services, deserve to be fully represented by duly appointed members of16 the authority's board; and17 WHEREAS, it is in the public interest that local governing authorities exercise their lawful18 powers fully, faithfully, and in a timely manner.19 NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES that20 this body recognizes the importance of the Rockdale County Boar d of Commissioners in21 exercising their lawful authority, and urges the board to promptly appoint qualified members22 to all vacant seats on the Rockdale County Water and Sewerage A uthority, including any23 seats presently held by holdover members whose terms have expired.24 BE IT FURTHER RESOLVED that the Clerk of the House of Representatives is authorized25 and directed to make appropriate copies of this resolution avai lable for distribution to the26 Rockdale County Board of Commissioners.27 H.
