11-2-512. Payment by buyer before inspection.

(1)
Where the contract requires payment before inspection nonconformity of the goods does not excuse the buyer from so making payment unless:#
1. (a)
  The nonconformity appears without inspection; or#
2. (b)
  Despite tender of the required documents the circumstances would justify injunction against honor under the provisions of this title (Code Section 11-5-109).#
(2)
Payment pursuant to subsection (1) of this Code section does not constitute an acceptance of goods or impair the buyer’s right to inspect or any of his remedies.#

L. 2002, p. 995, § 8, not codified by the General Assembly, provides that: “This Act shall become effective July 1, 2002, and shall apply to a letter of credit that is issued on or after July 1, 2002. This Act does not apply to a transaction, event, obligation, or duty arising out of or associated with a letter of credit that was issued before July 1, 2002.”
