Effect of tender or deposit in court before trial upon recovery of costs. If the defendant in an action for breach of contract, before trial, tenders to the plaintiff or deposits in court as much as or more than he finally recovers, no costs shall be recovered accruing subsequent to the tender or deposit. ## History Orig.
