Definitions. As used in this article, the term: (1) “Personally identifiable information” means any personal phone number, home address, or property or tax records of a protected person. (2) “Protected person” means any current or former: (A) Judge or justice of this state and his or her spouse; (B) Judge of any county or municipality of this state and his or her spouse; and (C) Judge or justice of the United States and his or her spouse. (3) “Publicly available content” means any written or electronic document or record that provides information or that serves as a document or record maintained, controlled, or in the possession of a state or local government entity that may be obtained by any person from the state or local government entity’s public website or from such state or local government agency upon request whether free of charge or for a fee. (4) “State or local government entity” means any: (A) Agency of the executive branch of this state; or (B) Any county or municipality of this state, including, but not limited to, any county or municipal court clerk’s office, board of elections, board of tax assessors, or board of ethics. ## History Code 1981, § 15-5-110, enacted by Ga. L. 2025, p. 802, § 1/HB 199, effective July 1, 2025. ## Code Commission Notes Pursuant to Code Section 28-9-5, in 2024, the definitions in paragraphs (3) and (4) were redesignated as paragraphs (4) and (3), respectively, to maintain alphabetical order. ## Amendments The 2025 amendment, effective July 1, 2025, substituted “personal phone number, home address, or property or tax records of a protected person” for “phone number or address affirmatively identified by a protected person for inclusion in the data base established and maintained pursuant to Code Section 15-5-111” in paragraph (1); substituted “Judge” for “Elected or appointed judge” in subparagraphs (2)(A) and (2)(B), substituted “Judge” for “Appointed judge” in subparagraph (2)(C); deleted former paragraph (3), which read: “‘Public posting or display’ means to communicate information or otherwise make information available to the general public.”; redesignated former paragraphs (4) and (5) as present paragraphs (3) and (4); in paragraph (3), substituted “state or local government entity’s public website” for “internet”; and, in subparagraph (4)(B), substituted “Any county or municipality of this state, including, but not limited to, any county or municipal court clerk’s office, board of elections, board of tax assessors, or board of ethics.” for “Any local governing authority of a county or municipality of this state.”
