Plan for regulation; approval. (a) Within 60 days of May 10, 2019, the Commissioner, in consultation with the Governor and Attorney General, shall submit to the secretary of agriculture of the United States a plan under which the department intends to regulate hemp production and which shall include: (1) A practice to maintain relevant information regarding land on which hemp is produced in this state, including a legal description of the land, for a period of not less than three calendar years; (2) A procedure to test the total delta-9-THC concentration of a sample; (3) A procedure to effectively dispose of products that are produced in violation of this chapter; and (4) A procedure to comply with the enforcement procedures outlined in Code Section 2-23-10. (b) If the secretary of agriculture of the United States disapproves the plan, the Commissioner, in consultation with the Governor and Attorney General, shall submit to the secretary of agriculture of the United States an amended plan. (c) The department may submit an amended plan to the secretary of agriculture of the United States if or when required by any amendment to this chapter, the rules and regulations promulgated by the department pursuant to this chapter, or any federal law or regulation. ## History Code 1981, § 2-23-11, enacted by Ga. L. 2024, p. 455, § 16/SB 494, effective October 1, 2024. ## Amendments The 2024 amendment, effective October 1, 2024, rewrote paragraph (a)(2), which read: “A procedure to test delta-9-THC concentration levels, by using postdecarboxylation or other similarly reliable methods, for hemp produced in this state;” and added subsection (c).
