2-23-9.3. Location of retail establishments selling or distributing consumable hemp products.

  1. (a)

    On or after July 1, 2024, no person shall create or begin operating in this state a retail establishment that sells or otherwise distributes consumable hemp products to consumers that is located within 500 feet of any educational institution, public or private, providing elementary or secondary education to children at any level, kindergarten through twelfth grade, or the equivalent thereof if grade divisions are not used by such institution.#

  2. (b)
    1. (1)

      As used in this subsection, the term:#

      1. (A)

        “Dispensing license” shall have the same meaning as provided in Code Section 16-12-200.#

      2. (B)

        “Low THC oil” shall have the same meaning as provided in Code Section 16-12-190.#

    2. (2)

      No person operating a retail establishment in this state that sells or otherwise distributes consumable hemp products to consumers shall advertise or represent such establishment as selling or otherwise distributing or being a dispensary of low THC oil or products containing low THC oil unless such person holds a dispensing license.#
