26-2-477. Construction.

  1. Nothing in this article shall be construed to:

  2. (1)

    Exempt a cottage food operator or seller from any applicable federal law, including, but not limited to, any federal law prohibiting the sale of certain food items in interstate commerce;#

  3. (2)

    Preclude the production or sale of food items otherwise allowed by federal, state, or local law;#

  4. (3)

    Preclude the sale of live animals or portions of live animals before slaughter for future delivery;#

  5. (4)

    Amend or otherwise alter any rule or regulation related to other goods and services provided where cottage food items are produced or sold;#

  6. (5)

    Exempt a cottage food operator or seller from any applicable tax law;#

  7. (6)

    Exempt a cottage food operator or seller from any applicable fishing or hunting law; or#

  8. (7)

    Exempt a cottage food operator or seller from any applicable law of another state.#
