Freedom of residents. (a) Each resident shall be free from a duty to perform services for the facility. (b) Each resident shall be permitted to rise and retire at times of his choice, if the resident does not interfere with the rights of others. (c) Unless contradictory to written admission policies of which the resident, guardian, or representative is informed prior to admission, each resident shall be permitted to use tobacco and to consume alcoholic beverages, subject to the facility’s policies and safety rules and applicable state law, if the resident does not interfere with the rights of others.
