# O.C.G.A. § 31-8-306. Settlements for prescription drugs that are not controlled substances; distributions.

(a) It is the intent of the General Assembly that a portion of the proceeds of settlements received by the state relating to prescription drugs that are not controlled substances be appropriated for purposes of the program and distributed to eligible recipients in proportion to each such recipient’s participation rate in the program.

(b) It is further the intent of the General Assembly that if funds are appropriated for purposes of this article, the department shall be required to distribute such appropriations to eligible recipients in proportion to each such recipient’s level of participation in the program.

Ga. L. 2024, p. 347, § 2-1/HB 1072, not codified by the General Assembly, provides: “The General Assembly finds:

“(1) Access to affordable medications is a public health issue that disproportionately impacts vulnerable patients, and a state’s drug repository program can serve as a solution to thousands of families for life-saving and life-preserving medications; and

“(2) Participating recipient organizations can provide a valuable community benefit to families in need by making donated medications available and will be authorized to utilize additional pharmacy technicians to distribute donated medications under the drug repository program.”

Pursuant to the terms of subsection (b), funds were not appropriated at the 2024 session of the General Assembly.

This Code section became effective April 23, 2024.
