Affidavit that insured’s motor vehicle stolen. (a) In any case where an insured has executed an affidavit affirming that such insured’s motor vehicle has been stolen, the insurer shall be required to accept by-hand delivery of such affidavit from such insured. (b) It shall be unlawful for any person who executes the affidavit provided for in subsection (a) of this Code section knowing that it purports to be an acknowledgment of a lawful oath or affirmation to hand deliver such affidavit if such person knowingly and willfully made a false statement in such affidavit. (c) Any person who violates subsection (b) of this Code section shall be guilty of a felony and, upon conviction thereof, shall be punished by imprisonment for not less than one nor more than five years or by a fine of not more than $10,000.00, or both. ## History Code 1981, § 33-1-15, enacted by Ga.
