38-3-42. Board’s duty to advise Governor; development of state-wide homeland security strategy; coordination with federal strategic guidance on homeland security; rules and regulations.

Ga. L. 2025, p. 332, § 9-3/SB 96, not codified by the General Assembly, provides: “Any assets of the Board of Homeland Security existing as of June 30, 2025, shall devolve by operation of law and without further action to the State of Georgia on July 1, 2025. Any liabilities and obligations of the Board of Homeland Security existing as of June 30, 2025, shall be transferred to and assumed by the State of Georgia, by such instruments as may be required to maintain the same.” The former article, relating to board of homeland security, consisted of Code Sections 38-3-40 through 38-3-42. Ga. L. 2025, p. 68, § 2-6/SB 68 purported to make changes to paragraph (4) of § 38-3-40, however this section was repealed by Ga. L. 2025, p. 332, § 9-2/SB 96, effective July 1, 2025.

Pursuant to Code Section 28-9-5, the amendment of paragraph (4) of Code Section 38-3-40 by Ga. L. 2025, p. 68, § 2-6/SB 68, was treated as impliedly repealed and superseded by Ga. L. 2025, p. 332, § 9-2/SB 96, due to irreconcilable conflict.
