# O.C.G.A. § 40-6-397. Aggressive driving.

(a) A person commits the offense of aggressive driving when he or she operates any motor vehicle with the intent to annoy, harass, molest, intimidate, injure, or obstruct another person, including without limitation violating Code Section 40-6-42, 40-6-48, 40-6-49, 40-6-123, 40-6-184, 40-6-312, 40-6-390, or 40-6-390.1 with such intent.

(b) Any person convicted of aggressive driving shall be guilty of a misdemeanor of a high and aggravated nature.

Ga. L. 2021, p. 228, § 11/HB 534, not codified by the General Assembly, provides that: “This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval and shall apply to all offenses committed on and after such date.” This Act was approved by the Governor on May 3, 2021.

The 2021 amendment, effective May 3, 2021, substituted “40-6-312, 40-6-390, or 40-6-390.1” for “40-6-312, or 40-6-390” near the end of subsection (a). See Editor’s notes for applicability.
