44-7-13. Landlord’s duties as to repairs and improvements.

  1. (a)

    The landlord shall keep the premises in repair and shall be liable for all substantial improvements placed upon the premises by such landlord’s consent.#

  2. (b)

    Any contract, lease, license, or similar agreement, oral or written, for the use or rental of real property as a dwelling place is deemed to include a provision that the premises is fit for human habitation.#

Amendments

The 2024 amendment, effective July 1, 2024, designated the existing provisions of this Code section as subsection (a); in subsection (a), substituted “shall” for “must”, “repair and” for “repair. He”, and “such landlord’s” for “his”; and added subsection (b). See Editor’s notes for applicability.

Ga. L. 2024, p. 91, § 1/HB 404, not codified by the General Assembly, provides: “This Act shall be known and may be cited as the ‘Safe at Home Act.’” Ga. L. 2024, p. 91, § 6/HB 404, not codified by the General Assembly, makes this Code section applicable to residential lease agreements that are entered into or renewed on or after July 1, 2024.
