45-9-84. Appeals of department decisions; use of personnel and resources of other agencies.

The commissioner or his or her designee is authorized to consider appeals of initial decisions of the department to correct errors made by the department in approving or denying any claim filed pursuant to this article upon a written request for formal review. The commissioner or his or her designee may modify or override the initial decision of the department upon a showing of an error of material fact or an abuse of discretion. The department shall be authorized to promulgate rules and regulations regarding the process and procedure for requests for formal review and appeal of initial decisions of the department. The department shall be authorized to contact other state agencies for the purpose of using the personnel and resources of such agencies to assist the commissioner or his or her designee in carrying out his or her duties under this article. Final decisions of the commissioner or his or her designee may be appealed to superior court for judicial review as set forth in Chapter 3 of Title 5, the “Superior and State Court Appellate Practice Act.”

Amendments
The 2023 amendment, effective May 3, 2023, substituted “commissioner or his or her designee” for “commission” throughout the Code section; in the first sentence, inserted “initial” preceding “decisions of the department” near the middle and added “upon a written request for formal review” at the end; near the middle of the second sentence, inserted “initial” preceding “decision of the department”; added the third sentence; in the fourth sentence, deleted “and the commission” following “The department” near the beginning and substituted “his or her duties under this article” for “its duties” at the end; and added the last sentence.
