# O.C.G.A. § 45-9-84.3. Georgia State Indemnification Fund — Authority of department as to payments from fund.

The department is authorized, subject to the limitations contained in this part:

(1) To pay the appropriate indemnification to the persons eligible for indemnification under this part from the proceeds of the Georgia State Indemnification Fund;

(2) To make such payments as may be necessary to defray the expenses and costs incurred by the department in administering this part; and

(3) To utilize the resources of the Georgia State Indemnification Fund to purchase insurance to provide for such indemnification.

## Amendments

The 2023 amendment, effective May 3, 2023, in paragraph (2), deleted “and the commission” following “incurred by the department”; and, in paragraph (3), substituted “To utilize” for “With the approval of the commission, to utilize” at the beginning.
