Capacity of trustee. A trustee shall have legal capacity under Georgia law to acquire, hold, and transfer title to property. An individual shall be eligible to serve as a trustee regardless of citizenship or residency. If the trustee is a corporation, partnership, or other entity, it shall be required to have the power to act as a trustee in Georgia pursuant to Code Section 7-1-242, Article 15 of this chapter, or other applicable law. ## History Code 1981, § 53-12-200, enacted by Ga. L. 2025, p. 806, § 78/HB 327, effective July 1, 2025. ## Amendments The 2025 amendment, effective July 1, 2025, added “pursuant to Code Section 7-1-242, Article 15 of this chapter, or other applicable law” in the last sentence.
