53-2-26. Effect of findings of court.

(a)
In the absence of fraud, the findings of the superior court or the probate court in a proceeding brought under this article shall be binding and conclusive as to every person and as to every issue decided.#
(b)
With respect to the judgment of the superior court or the probate court in a proceeding brought under this article, nothing in subsection (a) of this Code section shall be applied or construed to abrogate or infringe:#
1. (1)
  Any right of appeal provided by Title 5; or#
2. (2)
  Any right to relief provided by Code Section 9-11-60.#

The 2025 amendment, effective July 1, 2025, added the subsection (a) designation; inserted “in a proceeding brought under this article” in subsection (a); and added subsection (b).
