Summary
Written by an AI model (gpt-6.1-sol) from the transcript. It is not part of the record, and the video is what was said.
The committee reviewed and approved two measures concerning state property. HR 1050 authorizes property transfers and leases. Members approved an amendment increasing the acreage of a proposed Floyd County school-system lease, then held separate votes on the amendment and the resolution after procedural clarification. HR 1051 authorizes nonexclusive easements. Discussion focused on a drainage-dispute settlement, access to land left landlocked after state purchases, and a Georgia Power easement at the Atlanta Farmers Market. Both measures received voice-vote approval, with no opposition heard. The State Property Commission representative agreed to send the acreage amendment for legal drafting and return it to the chair’s office.

The State Property Commission’s deputy executive director presented proposed transfers and leases supporting transportation, education, emergency services and other uses. The representative described a Farmers Market turn-lane transfer, a Dawson County communications-tower lease, a DeKalb road-widening transfer, and leases for Easterseals, schools, a post office and disability housing. Other proposals included a McDuffie County land exchange and a Cedartown transfer for fire stations. Asked whether the $369,829 DeKalb price reflected market value, the representative said it did and that the state generally charges market value unless it receives another benefit. The representative said affected legislators had raised no concerns. A committee member questioned whether a Floyd County charter-academy lease lasted five or 25 years; the representative confirmed five years in the version under consideration. For a separate Floyd County school-system lease, the representative requested increasing the acreage from 16 to 30.5, retaining a 10-year term and one 10-year renewal option at $10 annually. Following initial votes and procedural clarification, the committee separately approved the amendment and resolution by voice vote, with no opposition heard. The representative agreed to obtain revised legal language and return it to the chair’s office.

The State Property Commission’s deputy executive director supplied two Department of Natural Resources letters addressing earlier questions about easements. For Altama Wildlife Management Area, the representative said a drainage easement would resolve claims that department alterations obstructed water flow from neighboring property. The representative said the settlement included replacement culverts at the property owner’s expense, stormwater improvements, flashboard risers and four contributions of $50,000, $75,000, $50,000 and $150,000. For Eupatoria Ravines Wildlife Management Area, the representative said the department had purchased about 8,800 acres from Timberlands 2 LLC to protect rare habitats and expand outdoor recreation. According to the representative, an access easement intended for retained, landlocked property had inadvertently been omitted from a survey; the proposal would correct that omission. The chair identified the retained parcel as 310 acres, which the representative confirmed. Asked about opposition letters, the representative said none had been received. Another member asked about Clayton County property, and the representative identified a 1.6-acre Georgia Power easement at the Atlanta Farmers Market. The committee approved the resolution by voice vote, with no opposition heard.

... uh, at $10 annually, and reimbursement to the Department of Natural Resources for $2,350 per year. And this is for a post office renewal lease. Polk County convey, uh, 3,000 acres, uh, which is, uh, commonly known as the Cedartown Adult Learning Center, to the City of Cedartown at a cost of $10 for the construction of a fire station.

- 0:16:40
Three... I'm sorry. Correction, on Polk County, I read that wrong.
- 0:16:45
Yeah.
- 0:16:45
It's to convey Three Point.
- 0:16:46
Three, Three Point.
- 0:16:46
Yeah.
- 0:16:47
Oh.
- 0:16:47
I apologize.
- 0:16:48
I got it understood. Right.
- 0:16:49
Yeah.
- 0:16:49
Right.
- 0:16:50
It's on your face.
- 0:16:55
In Richmond County, lease s- 7,500 square feet of, uh, two separate buildings. And then for the, uh, substitution there in Floyd County, uh, i- actually the, the-
- 0:17:51
We gotta remove this one.
- 0:17:52
Yes, sir. This, this is the one that we're requesting to amend. Uh, the w- the way it currently reads is, uh, lease 16 acres being a portion of the Georgia Northwestern Technical College campus to the Floyd County School System, uh, for a term of 10 years with one 10-year renewal option at $10 annually. And, uh, we're requesting to amend this to actually lease 30.5 acres rather than 16 acres.
- 0:18:21
And we need to send that back to Legislative Council.
- 0:18:22
Yes, sir. We'll-
- 0:18:23
Right
- 0:18:23
... this one have to go back to Legislative Council-
- 0:18:26
Right
- 0:18:26
... to be amended-
- 0:18:27
Okay
- 0:18:27

- 0:18:28
All right. Any questions or comments from members of the panel? Senator. Otherwise, uh, questions or comments or motions?
- 0:18:42
Any que- do I hear a motion to do pass?
- 0:18:48
Mr. Chairman, this, this-
- 0:18:50
W- with the understanding of we're gonna, without Polk County's action, to remove that one. To accept-
- 0:18:58
Mr. Chairman, we would ask HR 1050,
- 0:19:05
LC 650024, um, as amended for Floyd County.
- 0:19:18
Okay. But that, that should properly read, uh, that, uh, all of the conveyances except for Floyd County.
- 0:19:24
Except Floyd.
- 0:19:24
Uh, Polk County. I'm sorry. Floyd County, yes.
- 0:19:27
Floyd County.
- 0:19:27
Thank you. You had me saying it. Okay.
- 0:19:28
Floyd County.
- 0:19:29
Is that, would that take care of all-
- 0:19:30
Mr. Chairman, it, it, would, would... I, I guess, uh, the question would be can the committee go ahead to approve it as amended-
- 0:19:38
Okay
- 0:19:39
... and then-
- 0:19:39
And then you bring it back with the proper language. That-
- 0:19:39
... and then we have Legislative Council- Yes, sir
- 0:19:42
... uh, uh, do I have a second?
- 0:19:43
... uh, make the, the, the change.

- 0:19:56

- 0:20:16
This is the right one
- 0:20:17
... land.

- 0:20:24
LC 65... Oh. Yeah. Oh, maybe that's- Zero, zero. Correct. Is it correct? It's correct in that one? It's- Oh, great. Okay.

- 0:20:31
Okay.
- 0:20:31
On, on 118-
- 0:20:33
All right
- 0:20:33

- 0:20:36
Five years, okay.
- 0:20:36
Yes, sir.
- 0:20:36
All right. I believe this is- Great. Okay.

Thank you.
- 0:20:39
All right.
- 0:20:39
There we go. Thank you.
- 0:20:40
It's been moved and properly seconded. All in favor say aye.

Opposed like sign. Do we have any other action?
- 0:20:48
Uh, yes, sir. Um, the, the committee had requested additional information.
- 0:20:52
From senator from the 19th.
- 0:20:54
Yes, sir.
- 0:20:54
Right.
- 0:20:54
On House Resolution 1051.
- 0:20:57
Yes.
- 0:20:59
Um, and we received two letters from, uh, both from the Department of Natural Resources. Do, do y'all have a copy of those? I, I brought copies with me if I need to share that with the committee.
- 0:21:09
A- and may I ask, have we shared that with the senator from the 19th?
- 0:21:13
Yes, sir.
- 0:21:13
And-
- 0:21:13
That has been shared
- 0:21:14
... and he is okay with taking your word for it?
- 0:21:17
Yes.
- 0:21:17
And I'm sure that you represent your word well.
- 0:21:20
Yes, sir.
- 0:21:20
And that it, it's okay, everything's been settled and we in, we're in line and in compliance with what his thoughts were, right?
- 0:21:26
Yes, sir.
- 0:21:26
Or what would need to be said, that is.
- 0:21:28
Mm-hmm.
- 0:21:28
All right. Well, so we're good to go with that as well?
- 0:21:30
Yes, sir.
- 0:21:30
Okay. Well then, uh, well, you can go with that piece as well.
- 0:21:33
Absolutely.
- 0:21:33
All right. Yes, sir.
- 0:21:34
Um, in regards to, uh- In, uh, article-

Yes.
- 0:21:47
Uh, article 23, line 2015.
- 0:21:50
Well, let me go back.
- 0:21:51
Um, this is in reference to the non-exclusive drainage easement on Altama Wildlife Management Area.
- 0:21:58
Well, excuse me, what line was that again?
- 0:22:00
It's, uh, it starts on line 2015.
- 0:22:04
Okay.
- 0:22:07
2015.
- 0:22:08
2015. Okay.
- 0:22:08
Yes, sir. They, there was a request-
- 0:22:10
Okay
- 0:22:10
... to get additional information-
- 0:22:12
I got it
- 0:22:12
... regarding this one. Uh-
- 0:22:14
Section 287?
- 0:22:16
Yes, sir.
- 0:22:17
All right. Go ahead.
- 0:22:19
On, uh, January 26th, the Department of Natural Resources entered into a settlement agreement with Altama HIC, Altama LLC, uh, regarding claims that the Department of Natural Resources made alterations to the Altama Wildlife Management Area, which impeded the natural flow of water from the Hoyer property. And on February 24, 2026, the Board of Natural Resources voted to approve the non-exclusive drainage easement to resolve the hydrological dispute between Department of Natural Resources and Hoyer.
- 0:22:56
Um, in return for granting the non-exclusive drainage easement, uh, to Hoyer, uh, the Department of Natural Resources will receive several benefits as a part of this agreement, um, which are listed in the letter. Uh-
- 0:23:10
Let me go back to the letter then.
- 0:23:12
That, that includes, uh, 20, uh, the replacement of 24-inch culverts at the, the cost of Hoyer, um, stormwater outfalls, the installation of flashboard risers, and then cap, uh, capital contributions to the Department of Natural Resources, uh, for, uh, multiple thing. One 50,000, one 75,000, one 50,000, and then another for 150,000.
- 0:23:43
A- and this is, uh, I had a conversation with Representative Buckner, but this is entirely different from the state money that was given because they, uh, claimed some land in Talbot County, which is my county. I- is this-
- 0:23:59
Yes, we've, we've also-
- 0:24:00
So this is a different-
- 0:24:01
We've, I've also got a, a letter for that one-
- 0:24:03
Okay
- 0:24:03
... as well.
- 0:24:03
All right, go right ahead.
- 0:24:04
Mm-hmm.
- 0:24:05
Okay.
- 0:24:06
Any other questions about the-
- 0:24:08
No
- 0:24:08
... Hoyer?
- 0:24:10
No, go right ahead.
- 0:24:11
Uh, the other one that, that we were requested to get additional information on was the a- access easement across the Eupatoria Ravines Wildlife Management Area in Talbot County. Is that the one you're referring to-
- 0:24:24
Yes
- 0:24:24
... Mr. Chairman? Um, this relates to the ongoing acquisition of property from Timberlands 2 LLC. Uh, to date, the Department of Natural Resources has purchased right at 8,800 acres from Timberlands 2, and the acquisition of this property, uh, has, they, they, they've actually, uh, acquired this property to protect rare habitants and provide new opportunities for the public, and public and to pursue outdoor recreation.
- 0:24:58
During pha- the phase two acquisition, the property survey was supposed to include an access easement to some property that is landlocked that Timberlands owns-
- 0:25:09
I'm with you, right
- 0:25:10
... and it was, uh, inadvertently left off of the easement.
- 0:25:13
Yeah.
- 0:25:14
And so this is to... Or it was left off the survey. And so this is to go back and add that easement.
- 0:25:19
This is the last paragraph in the letter, 310 acres.
- 0:25:22
Yes, sir.
- 0:25:23
Okay.
- 0:25:23
Mm-hmm. So this just provides them with access to their property that's landlocked as a result of the-
- 0:25:30
Okay
- 0:25:31
... acquisition-
- 0:25:32
All right
- 0:25:32
... of the property.
- 0:25:32
All right. Have we had any o- uh, letters of opposition from the-
- 0:25:37
No, sir
- 0:25:37
... anybody that, that... Okay. Any other questions or comments from members of the committee? What is your ple- Yes, Sen-
- 0:25:45
Senator. Let me just ask-
- 0:25:47
Go ahead, Senator.
- 0:25:48
Who we have, you have on here, I see Clayton County. Is that the, is this the same one that you, in reference to, uh, where is that property located?
- 0:25:58
Clayton County?
- 0:25:59
Mm-hmm. Clayton. Ooh.
- 0:26:01
You're going back to, you're go- you, you, you're going back to Clayton County, you said?
- 0:26:05
HR 1050.
- 0:26:06

That, that's 1050
- 0:26:09

It's, on 1051 it's still, it names all these counties. I'm just trying to see are we referring to the same, s- s- same property-
- 0:26:18
Uh, no, ma'am. This was-
- 0:26:19
... or a different property
- 0:26:19
... Talbot County
- 0:26:20
Where is this?
- 0:26:20
Oh, okay. All right.
- 0:26:23
And-
- 0:26:23
You see on-
- 0:26:24
I got it. I got it
- 0:26:25
... resolution, the first, on, on line four, when you reference those properties, I'm trying to see where, where are those properties? I mean-
- 0:26:33
Okay
- 0:26:34
... where is that property in Clayton County you referencing to?
- 0:26:37
Clayton County.
- 0:26:38
I can't-
- 0:26:38
That, that's in reference to an easement that's being, uh, it's a, uh, to grant an easement to the Georgia Power Company-
- 0:26:45
Ge- okay
- 0:26:46
... for 1.6 acres-
- 0:26:48
Okay
- 0:26:48
... at the Atlanta Farmer's Market.
- 0:26:51
Okay.
- 0:26:52
I don't know where it is on the bill.
- 0:26:54
In the sum- in the summaries right there. Okay.
- 0:26:58
Are you clear, Senator?
- 0:26:59
Thank you. I am.
- 0:27:00
All right.
- 0:27:00
Okay. Any other questions, Chairman?
- 0:27:04
Members of the committee, any other questions? Otherwise, what's your pleasure? Do I hear a motion to approve?
- 0:27:11
So mo-
- 0:27:12
Yes.
- 0:27:13
So moved, Mr. Chairman.
- 0:27:14
Do I hear a second?
- 0:27:15
Second.
- 0:27:16
Moved and properly seconded. All in favor say aye.
- 0:27:19
Aye.
- 0:27:20
Aye.
- 0:27:20
Opposed, like sign. And I believe that's all coming before us today-
- 0:27:24
Yes
- 0:27:24
... right?
- 0:27:25
Yes.
- 0:27:25
And we'll take it all out to dinner next week after signing, right?
- 0:27:30
Yes.
- 0:27:30
Thank you very much. Appreciate it, gentlemen.
- 0:27:31
Thank you, Chair.
- 0:27:32
This has been a very complex one and-
- 0:27:35
Yes, sir
- 0:27:35
... and, and we usually have sort of easy flow with that one. I noticed d- Dean Green was not with us today. I'm gonna fine him a dollar for being late. Yeah.
- 0:27:45
Sorry.
- 0:28:16
1051, the counsel's telling us we need to do another vote to, vote, vote to approve, right? We did the amendment, now we need to do the amendment to approve it, right?
- 0:28:26
Yes. The one we amended, which I believe was, we did 1050 first.
- 0:28:30
Yes.
- 0:28:31
One vote to amend to end vote, and we need to split that.
- 0:28:33
All right.
- 0:28:34
So we can do the amendment vote.
- 0:28:35
All right. Do we have a vote, uh, to amend, uh... I'm sorry, ev- I'm getting a little mixed up here myself. That was 1050. Resolution 1050-
- 0:28:44
Yes
- 0:28:44
... I'm told we need to do another vote. All, all in favor say aye. Aye. Opposed, like sign. This is for the amendment. Then now we need another vote for, to ap- approval, right? All in favor say aye. Approval. Aye. Now we set all... I- I vote aye too. Approved. I'm sorry.
- 0:29:04
Thank you, Mr. Chairman.
- 0:29:06
I'm sorry about the mix-up. All right.
- 0:29:06
Mr. Chairman, uh, will your office send it to the legislative council to have it amended or do, would you like for us to do that?
- 0:29:12
You, you, you... Why don't you do that?
- 0:29:13
Yes, sir.
- 0:29:14
And we'll, we'll look at it-
- 0:29:15
Okay
- 0:29:15
... and make sure it's right, okay.
- 0:29:16
Okay.
- 0:29:16
And I apologize for the amendment.
- 0:29:18
And once they amend it-
- 0:29:18
Appreciate it
- 0:29:18
... they'll send it back to your office.
- 0:29:20
Appreciate it. Yes. Sorry about that. I've been doing this 30 years, right.
- 0:29:32
I thought we were rolling. And I was wondering why you were moving, but, um, you know, my one kind of swept me on. All right. Meeting's adjourned. Thank you.
