HB 1519: Peachtree City Public Facilities Authority; terms of office for certain members; provide

The City of Peachtree City Public Facilities Authority was created by a 2011 state law. This bill amends that law to spell out how long authority members serve and to clarify that a seat on the authority is not property that can be transferred or sold. Under the bill, the mayor and council appoint the authority's five members, and city councilmembers or the mayor may also serve. New appointments are for staggered initial terms of one, two, or three years, and after that all appointments run for three years, except that a member who is also a city councilmember serves only as long as their council term lasts. The bill also states that membership cannot be assigned or transferred to someone else and gives a member no financial stake in the authority's assets or property. The changes take effect once the Governor signs the bill or it becomes law without a signature.

• Sets authority member terms at three years going forward, after an initial staggered schedule of one, two, and three year terms.
• Ties a member's term to their city council term if that member also serves on the Peachtree City council.
• Bars any member from transferring or assigning their seat on the authority to another person.
• Declares that authority membership gives no benefit, right, or ownership interest in the authority's assets or property.
• Keeps existing eligibility rules requiring members to be at least 21, a two-year city resident, and free of felony convictions.
• Sets the effective date as the day the Governor signs the bill or it becomes law without a signature.

Members and prospective members of the City of Peachtree City Public Facilities Authority, the Peachtree City mayor and city council who make the appointments, and any sitting councilmembers who also serve on the authority.

The bill clarifies how long people serve on a local public authority and removes any ambiguity about whether a council member's authority seat outlasts their council term. It also makes clear that a seat cannot be treated as a transferable or financially valuable position.

• Section 1 revises subsection (b) of Section 2 of the 2011 Act to set a three-year term length for authority appointments after the initial staggered terms.
• Section 1 ties a councilmember-authority-member's term to their concurrent city council term of office.
