A BILL TO BE ENTITLED
AN ACT
To amend an Act to create the City of Peachtree City Public Facilities Authority, approved May 13, 2011 (Ga. L. 2011, p. 4121), as amended, so as to provide for terms of office for certain members of the authority; to prohibit transfer of membership in the authority; to provide for members not receiving any benefit of or right to or interest in assets of the authority; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
An Act to create the City of Peachtree City Public Facilities Authority, approved May 13, 2011 (Ga. L. 2011, p. 4121), as amended, is amended by revising subsection (b) of Section 2 as follows:
"(b)(1) The authority shall consist of five members who shall be appointed by the mayor and council of the City of Peachtree City. City councilmembers and the mayor may be appointed as members of the authority. With respect to the initial appointment by the mayor and council of the City of Peachtree City, two members shall be appointed for a term of three years, two members shall be appointed for a term of two years, and one member shall be appointed for a term of one year. Thereafter, all appointments shall be made for terms of three years and until successors are appointed and qualified, provided; however, that any member of the authority who is also a member of the city council shall serve for a term of office concurrent with such councilmember's term of office in the city council. Immediately after such appointments the members of the authority shall enter upon their duties. To be eligible for appointment as a member of the authority a person shall be at least 21 years of age, shall be a resident of the City of Peachtree City, Georgia, for at least two years prior to the date of his or her appointment, and shall not have been convicted of a felony. Any member of the authority may be selected and appointed to succeed himself or herself.
(2) The membership, or interest, in such office shall not be assignable or otherwise transferable. Membership in the authority shall not confer upon any member any benefit of or right to or interest in any of the assets or properties of the authority."
SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
