HB1519: HB1519 Peachtree City Public Facilities Authority; terms of office for certain members; provide

This bill amends the 2011 state law that created the City of Peachtree City Public Facilities Authority, a body appointed by the mayor and city council to oversee certain public facilities. It rewrites the section covering how members are appointed and how long they serve. Under the change, the authority still has five members appointed by the mayor and council, with initial staggered terms (two members for three years, two for two years, one for one year) and three-year terms after that. It adds a specific rule that any authority member who is also a sitting city councilmember serves only as long as their council term lasts. It also newly states that membership on the authority cannot be assigned or transferred to someone else, and that being a member does not give a person any ownership interest or benefit in the authority's assets or property. The law would take effect as soon as the Governor signs it or it becomes law without his signature.

Members of the City of Peachtree City Public Facilities Authority, the mayor and city council of Peachtree City who make the appointments, and any city councilmembers who also serve on the authority.

The change clarifies that a councilmember-authority member loses their authority seat when they leave the council, preventing overlap confusion, and makes clear no member can sell, transfer, or claim ownership interest in the authority's public assets.

• Section 1 revises subsection (b) of Section 2 of the 2011 Act creating the authority (Ga. L. 2011, p. 4121).
• Keeps the five-member authority appointed by the mayor and council, with staggered initial terms of three, two, and one years and three-year terms thereafter.
• Adds that a member who is also a city councilmember serves a term matching their city council term of office.
• Adds a new provision that authority membership is not assignable or transferable.
• Adds a new provision that membership confers no benefit of, right to, or interest in the authority's assets or properties.
• Section 2 sets the effective date as upon the Governor's approval or upon the bill becoming law without approval.
• Section 3 repeals conflicting laws.
