All right. It's 8:00, and we're gonna go ahead, and we have a quorum. And, uh, so, uh, Representative Vance, would you mind to lead us off in prayer?

  2. 0:12:31

Thank you, Mr. Chairman. God, we do thank you for another gorgeous day you've given us. And we ask that at this time of year and this time where we're here in the session to, uh, grant us patience, keep us calm, uh, keep us focused on you, help us to do the will that you'd have us to do, and we ask that you be with everyone here

  3. 0:12:55

today as we do the business of the state of Georgia, and we ask all these things in Jesus' name.

  4. 0:14:04

    Amen.

  5. 0:14:08

    Amen.

  6. 0:14:08

If we recognize, if I can recognize these pages from

  7. 0:14:12

    Okay. I'll let you, uh...

  8. 0:14:17

    Morning, Jason.

  9. 0:14:22

    Here you go, Representative.

  10. 0:14:26

Thank you, Mr. Chairman. Good morning to everybody this morning, but I got three special folks here I wanna recognize. If y'all would, stand up. Y'all have, I've got three pages from Franklin County today.

  11. 0:14:41

And they were, and they were able to get down 85 without any problems to get here in time to page today. And, uh, even though they missed a lot of excitement yesterday, they get the chance to sit in a committee meeting today, something that other pages barely ever do. Thank y'all for being here.

  12. 0:14:59

All right. Thank you. All right, Chairman Corbett. We only have one bill today, and you have a substitute, so...

  13. 0:15:09

I, I do. Sorry. Thank you, Mr. Chairman, members of the committee. I bring before you LC395030S. I left my glasses in my office, so I'm gonna have to look like I'm holding stuff away. I, I, I think I can make it. But, uh, anyway, I wanna first thank Representative Montahan for making the motion to reconsider, where I could have a chance to work with the members on the committee and address some issues that they had today. So I wanna appreciate that, uh, motion yesterday, and able to reconsider this bill. So we made, uh, some, three minor changes to the bill, and that's what I'm gonna discuss this morning.

  14. 0:15:42

It will not, not take, take very long. And if you look on page 19, uh, that's where we set up the advisory council. Uh, these members will be, uh, and their purpose is to, you know, uh, uh, assist the department in the transition period over transitioning, uh, all the ru- the, uh, rule making, everything over to the Department of Revenue. Uh, their terms will be for three years. Uh, and then it will continue on, and they'll be re- reappointed, uh, after that, that three years.

  15. 0:16:13

New members will, will come on board. But anyway, so that will be part of the advisory council. Uh, it talks about their, you know, what they will do. They'll review existing rules, the, you know, ones to keep, ones to modify, and ones to do away with. Uh, talks about their meetings, the electronic licenses. And then, then we get to, if you would turn over to the last page of the bill, page 48, uh, lines 1201, uh, the last two sections of the bill, three and four.

  16. 0:16:45

It was basically the sections in there yesterday, the powers and authority, uh, that was transferring all to the Department of Revenue. None of this will take effect until July 1, 2028, that's the two years, and, uh, if, if funds are in the budget to do that. So that's, that, that's the changes in the bill, uh, Mr. Chairman. And, uh, working with the, with the members, uh, I think that addresses their concerns. And, uh, I'll take any questions if, if there are any. And if not, I'll ask for your favorable consideration.

  17. 0:17:16

All right, we have a question. Chairman Prince.

  18. 0:17:18

Uh, thank you, Mr. Chairman. Thank you, Mr. Chairman, for, uh, uh, taking, uh, going back and making updates to this. Uh, my question is, reference the board that was there, uh, up under the SOS. Will that board remain in place until, uh, until this transition, uh, makes it through?

  19. 0:17:38

Yes, the, the board stays intact under the SOS until July 1, 2028, when you got that two-year transition period where this advisory council is reviewing all the rules and regs and making sure any gaps that we talked about yesterday in the, in the trans, make sure all those was addressed before. It gives us a two, two-year run- runway-

  20. 0:17:54

    A runway

  21. 0:17:54

... to take care of any, any, any issues that come up that, that, that we need to address.

  22. 0:17:59

Thank you for your work on this.

  23. 0:18:02

    Representative Taylor.

  24. 0:18:04

Yes, thank you, Mr. Chairman, and thank you, Mr. Chairman, for, um, the willingness to work with us on this one. My question is, did we address the concern about the appointment of those advisory council members?

  25. 0:18:16

W- we, we did. They're, they're appointed by the commissioner, and they, they, of, of Department of Revenue, and it's from, uh- Mem- the boards, the five members, and they have to be members that, uh, are in the used car business, that are, are capable of holding a used car dealer's license or, or parts dealer's license.

  26. 0:18:35

Okay. And if I will, if I can, Mr. Chairman, um, I asked you yesterday out, out of a concern about the e-commerce. I'm new to this. So, and you explained to me that there is no such separation of e-commerce. There are used car dealers and the definition and the licensings falls broadly.

  27. 0:18:53

    The-

  28. 0:18:53

Can you elaborate on that for me please?

  29. 0:18:54

That, that, that is correct. You got the, the one license, used car, motor de- ve- vehicle, used motor vehicle dealer license, and that's the one, same license they get now. That hadn't changed.

  30. 0:19:03

    Okay. Thank you.

  31. 0:19:05

    Representative McClain.

  32. 0:19:06

Thank you, Mr. Chairman, and thank you, Mr. Chairman, for, for working with us too. And, uh, I do appreciate that too. So the only thing I wanted to say was, again, thank you, uh, for working with us, uh, one, and two, at the proper time, uh, Mr. Chairman.

  33. 0:19:23

    Second.

  34. 0:19:24

    All right. Cool.

  35. 0:19:28

Three to three. I got the... Allen. Chairman Powell.

  36. 0:19:33

Thank you, Mr. Chairman. And I wanna also thank the chairman for his work for the last several years on this, trying to do some things to clean this up to make us a more stable business for both the consumers and for public safety. Uh, I, at the proper time I'd like to, since we've had a motion and a second, I'd like to offer an amendment to this, if this is the proper time. I had asked, uh, our counsel to locate the position, and she'll give us a line number.

  37. 0:20:05

Since the, uh, used car board's gonna stay into effect, one of the things that has become quite popular among both parties of the legislature is putting these rule and reg making, uh, powers under the Administrative Procedures Act, so they'll be reported back to the legislature. Uh, as you remember, bipartisan bill that was passed earlier in the session, but this just puts into it in case something happens to the general bill. I've consulted with the Secretary of State's representative, and they have no problems.

  38. 0:20:36

They're in agreement to that. So this, you may remember what the APA does, is that any, uh, rule or reg has got, is subject to the APA, and it's then reported back to the legislature, to both houses, uh, to be sure it's, uh, in line with the law.

  39. 0:20:55

And I would ask counsel to, to read the amendment.

  40. 0:20:58

Yeah. Jenna, could you read that? Come to a mic too. I'm sorry.

  41. 0:21:08

All right. So on between line 461 and 462, we're gonna insert, um, Chapter 7 of Title 43 of the Official Code of Georgia Annotated relating to used motor vehicle and used motor vehicle parts dealers is amended by adding a new code section to read as follows: um, 43-47-6.1. Um, and the new language will be, "The board established pursuant to this chapter shall be subject to Chapter 13 of Title 50, the Georgia Administrative Procedures Act." And then I'll, um, there'll be a new Section 2.2 for the current language on four six, line 462, and I will, um, also update the title to reflect the changes that we're making here.

  42. 0:21:48

Thank, thank you, Jenna. And I make that motion.

  43. 0:21:56

All right. So we got a motion and a second on the amendment. All those in favor of the amendment?

  44. 0:22:00

    Aye.

  45. 0:22:00

    Sam?

  46. 0:22:01

    Aye.

  47. 0:22:02

    All those against? All right.

  48. 0:22:06

    Matt.

  49. 0:22:06

    I'm sorry.

  50. 0:22:07

    I also have a motion.

  51. 0:22:09

    Okay.

  52. 0:22:11

To correct, uh, official section, code section on 902.

  53. 0:22:16

    902?

  54. 0:22:17

Oh. Hit the mic. Section 902. Which line 902? Uh, it's right after section code. Uh, the new co- uh, new, uh, n- uh, code is 48-10-5, and she can clarify that for me.

  55. 0:22:33

Yeah, it's just the, the wrong cross reference there, um, to the... It's cle- a scrivener's error.

  56. 0:22:39

Can you give me the specific-

  57. 0:22:40

    Yep. Thank you.

  58. 0:22:42

    Thank you.

  59. 0:22:42

All right. So we have a motion to make another fix on the bill. Is there a second?

  60. 0:22:47

    Second.

  61. 0:22:48

Motion and a second. All those in favor?

  62. 0:22:51

    Aye.

  63. 0:22:52

Any against? All right. Now, now that we have the, uh, the amendments, let's vote on the bill. Uh, do, um, what's the bill of the committee on the bill as amended with both amendments? All those in favor say aye.

  64. 0:23:07

    Aye.

  65. 0:23:08

Any against? All right. Mr. Chairman, you got your bill.

  66. 0:23:12

Thank you, Mr. Chairman. Appreciate everybody getting up early.

  67. 0:23:15

That's all we have for the meeting today. We are done.

  68. 0:23:19

    We, we, we're burning daylight.

  69. 0:23:29

    Wow.
