HB 380: Lower Chattahoochee Regional Airport Authority; repeal Act

The Lower Chattahoochee Regional Airport Authority was created by a 2006 state law and later amended in 2010 and 2012. This bill would repeal that authority's creating law entirely, ending the authority as a separate legal body. Instead of leaving the authority's property and debts unresolved, the bill automatically transfers all of its assets and obligations to Randolph County, Georgia. The Randolph County Board of Commissioners is given the power to sign deeds and other legal documents needed to move title of the assets into the county's name, and it may do so either as Randolph County or in the authority's own name. The same applies to any debts or obligations the authority owed, which become the county's responsibility. The bill also repeals any conflicting laws. Although passed by both chambers, the bill was vetoed on May 14, 2025.

• Repeals in its entirety the 2006 law that created the Lower Chattahoochee Regional Airport Authority, as later amended in 2010 and 2012.
• Automatically transfers all assets of the airport authority to Randolph County, Georgia, without requiring further legal action.
• Authorizes the Randolph County Board of Commissioners to sign deeds and conveyance documents to move asset titles into the county's name, using either the county's or the authority's name.
• Shifts all of the airport authority's outstanding obligations, meaning debts or contractual duties, to Randolph County and lets the county execute documents to assume them.
• Repeals any other state laws that conflict with this Act.

Randolph County government, which would take over ownership of the airport authority's property and its debts, and the Lower Chattahoochee Regional Airport Authority itself, which would cease to exist. Anyone doing business with or holding contracts tied to the authority would now deal with Randolph County instead.

If enacted, the airport authority would no longer exist as a separate government entity, and Randolph County would directly own the airport property and be responsible for its debts. This changes who manages the airport and who is legally accountable for its finances and obligations going forward.

• Section 1 repeals the entire 2006 Act that created the Lower Chattahoochee Regional Airport Authority, including its 2010 and 2012 amendments.
• Section 2 transfers all of the authority's assets and liabilities to Randolph County automatically and authorizes the county commission to execute deeds and other instruments to formalize the transfer.
• Section 3 repeals any other laws that conflict with this Act.
