HB 436: Education; repeal Chapter 2B, relating to promise scholarship accounts; provisions

Georgia currently has a law, Chapter 2B of Title 20 of the Official Code of Georgia Annotated, that created promise scholarship accounts. That chapter has two parts: one establishing the Georgia Education Savings Authority, and one creating the Georgia Promise Scholarship Act, which lets eligible students use state funds toward private school tuition or other approved education expenses instead of attending their assigned public school. This bill would repeal Chapter 2B in full, removing both articles from Georgia law. It does not replace the program with anything else or lay out a transition plan for students already using promise scholarship accounts. The bill also repeals any other laws that conflict with this repeal, a standard clause in Georgia legislation.

• Repeals Chapter 2B of Title 20 of the Official Code of Georgia Annotated, which governs promise scholarship accounts.
• Eliminates Article 1 of that chapter, which established the Georgia Education Savings Authority.
• Eliminates Article 2 of that chapter, known as the Georgia Promise Scholarship Act.
• Repeals any other Georgia laws that conflict with this repeal.

Students and families currently enrolled in or eligible for Georgia's promise scholarship accounts, the Georgia Education Savings Authority that administers the program, private schools that accept promise scholarship funds, and the Georgia Department of Education, which oversees the broader scholarship framework.

If enacted, families relying on promise scholarship accounts to pay for private school tuition or other approved education expenses would lose access to that state funding source, and the state agency created to run the program would no longer have legal authority to operate.

• Section 1 repeals Chapter 2B of Title 20, removing both Article 1 (the Georgia Education Savings Authority) and Article 2 (the Georgia Promise Scholarship Act) from state law.
• Section 2 repeals any other laws or parts of laws that conflict with this Act, a standard closing provision.
