SB 134: Education; repeal Chapter 2B, relating to promise scholarship accounts, including both Articles 1 and 2 of said chapter

Georgia currently has a chapter of state law (Chapter 2B of Title 20) that set up promise scholarship accounts, made up of two parts: one creating the Georgia Education Savings Authority and another establishing the Georgia Promise Scholarship Act. Together these laws allow families to use state funds for education expenses outside traditional public schools. This bill would erase that entire chapter from Georgia law. Section 1 repeals Chapter 2B in its entirety, wiping out both the Authority that administers the accounts and the underlying Promise Scholarship Act that created them. Section 2 repeals any other laws that conflict with this change. The bill does not create a replacement program or specify an effective date beyond the standard process for a bill signed into law.

• Repeals Chapter 2B of Title 20 of the Official Code of Georgia Annotated in its entirety, eliminating the promise scholarship account system.
• Eliminates the Georgia Education Savings Authority, the entity created under Article 1 of that chapter to run the accounts.
• Eliminates the Georgia Promise Scholarship Act itself, the law under Article 2 that established the scholarship program.
• Repeals any other Georgia laws that conflict with this repeal, clearing the way for the chapter's full removal.

Families who use or could use Georgia's promise scholarship accounts, the Georgia Education Savings Authority that administers the program, private and home schools that may receive funds through it, and public schools whose funding interacts with the scholarship program.

If enacted, families that rely on promise scholarship accounts to pay for private school or other education expenses would lose access to that funding source, since the agency and law authorizing the accounts would no longer exist under Georgia law.

• Section 1 repeals Chapter 2B of Title 20, which covers both Article 1 (the Georgia Education Savings Authority) and Article 2 (the Georgia Promise Scholarship Act), removing the entire promise scholarship account framework.
• Section 2 repeals any conflicting laws, a standard clause ensuring no other statute contradicts the repeal.
