10-6B-81. Application of Chapter 6B.

  1. (a)

    This Code section and Code Section 10-6B-19 shall apply retroactively to powers of attorney created before July 1, 2018. The remainder of this chapter shall not apply to a power of attorney executed before July 1, 2017.#

  2. (b)

    When this chapter applies to a power of attorney pursuant to Code Section 10-6B-3, Chapter 6 of this title shall not apply to such power of attorney.#

  3. (c)

    When, other than this Code section and Code Section 10-6B-19, this chapter does not apply to a power of attorney:#

    1. (1)

      It shall not affect the application of Chapter 6 of this title; and#

    2. (2)

      The former provisions of Article 7 of Chapter 6 of this title, as such existed on June 30, 2017, shall remain applicable.#

Amendments

The 2025 amendment, effective July 1, 2025, inserted “This Code section and” at the beginning of subsection (a); in subsection (b), substituted “When this chapter” for “When Code Section 10-6B-3” and inserted “pursuant to Code Section 10-6B-3”; and inserted “this Code section and” near the beginning of subsection (c).
