19-11-25. Availability of information about overdue support to consumer reporting agency; notice to debtor parent; fee.

  1. (a)

    In accordance with Section 466(a) of the federal Social Security Act, the department shall make available information regarding the amount of overdue support owed by an absent parent residing in the state to any consumer reporting agency, as defined in Section 603(f) of the federal Fair Credit Reporting Act, upon the request of such agency.#

  2. (b)

    If the amount of overdue support involved in any case is less than $1,000.00, information regarding such overdue support may be made available in the discretion of the department.#

  3. (c)

    Any information with respect to an absent parent shall be made available only after notice of the proposed action has been sent by the department to such absent parent and such absent parent has been given a reasonable opportunity to contest the accuracy of such information.#

  4. (d)

    The department may collect a fee from the recipient for furnishing such information not to exceed the actual cost thereof.#
