21-2-76. Eligibility of person to serve as county election superintendent.

No person who holds elective office, as defined in this chapter and including every municipal office to which persons can be elected by a vote of the electors under the laws of this state, shall be eligible to serve as county or municipal election superintendent during the term of such elective office; and the position of any election superintendent shall be deemed vacant upon such superintendent’s qualifying as a candidate for elective public office, as defined in this chapter and including any municipal office to which persons can be elected by a vote of the electors under the laws of this state.

Amendments
The 2024 amendment, effective January 1, 2025, deleted “but excluding the office of probate judge” following the first occurrence of “state” and deleted “other than a probate judge” following the second occurrence of “superintendent” in this Code section.
