36-7-9. Establishment of fees.

The county surveyor shall be allowed to establish a reasonable fee for each of the following acts:#

1. (1)

   Surveying a town lot and returning a certificate thereof;#

2. (2)

   Surveying a tract of land;#

3. (3)

   Making a plat and recording, advertising, and transmitting the same to the Secretary of State’s office;#

4. (4)

   Making a resurvey of land by order of court;#

5. (5)

   For every other survey, making and certifying a plat thereof and transmitting the same;#

6. (6)

   Running lines between counties or districts or making new lines, per day, the county surveyor furnishing the chainbearer and provisions;#

7. (7)

   Making a plat of homestead, affidavit, and return;#

8. (8)

   Making each additional plat where there is more than one lot; and#

9. (9)

   Making any other survey he may be called upon or required to perform.#

10. The fee established by the county surveyor shall be reasonably equivalent to the same fee which would be charged if the survey had been conducted by a private surveyor.

The county surveyor shall be allowed to contract for his services in the same manner as private surveyors, whenever he is called upon or required to make a survey for a private or a corporate benefit or by order of the county governing authority or by order of the court.#
