A BILL TO BE ENTITLED
AN ACT
To amend Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, relating to medical assistance generally, so as to transfer Medicaid coverage for foster children from managed care to fee-for-service; to provide for definitions; to provide for submission of state plan amendments if necessary; to provide for automatic repeal; to provide for related matters; to provide for an effective date; to repeal conflicting laws; and for other purposes.
BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION 1.
Article 7 of Chapter 4 of Title 49 of the Official Code of Georgia Annotated, relating to medical assistance generally, is amended by adding a new Code section to read as follows:
"49-4-159.5.
(a) As used in this Code section, the term:
(1) 'Contract' means the agreement in effect on the effective date of this Code section between the department and a care management organization to provide managed care medical assistance coverage for foster children.
(2) 'Foster child' means an individual who:
(A) Is less than 18 years of age and is in a foster home or otherwise in the foster care system under the Division of Family and Children Services of the Department of Human Services; or
(B) Is less than 26 years of age, was in a foster home or otherwise in the foster care system in this state, and was receiving Medicaid coverage on his or her eighteenth birthday.
(b) Upon expiration or renewal of the contract, or earlier if authorized under the terms of the contract, the department shall transfer all medical assistance coverage for foster children from the care management organization to the fee-for-service Medicaid program.
(c) The department shall submit any Medicaid state plan amendments necessary to fulfill the requirements of this Code section to the federal Department of Health and Human Services.
(d) This Code section shall stand repealed on December 31, 2028."
SECTION 2.
This Act shall become effective upon its approval by the Governor or upon its becoming law without such approval.
SECTION 3.
All laws and parts of laws in conflict with this Act are repealed.
