A BILL TO BE ENTITLED

AN ACT

To amend Code Section 16-11-30 of the Official Code of Georgia Annotated, relating to riot, so as to provide for a felony penalty; to amend Code Section 17-6-1 of the Official Code of Georgia Annotated, relating to when offenses bailable, procedure, schedule of bails, and appeal bonds, so as to include the offense of riot; to provide for related matters; to repeal conflicting laws; and for other purposes.

BE IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.

Code Section 16-11-30 of the Official Code of Georgia Annotated, relating to riot, is amended as follows:

"16-11-30.

(a) Any two or more persons who shall do an unlawful act of violence or any other act in a violent and tumultuous manner commit the offense of riot.

(b) Any persons who violate subsection (a) of this Code section are guilty of a ~~misdemeanor~~ felony punishable by imprisonment for not less than one nor more than 20 years."

SECTION 2.

Code Section 17-6-1 of the Official Code of Georgia Annotated, relating to when offenses bailable, procedure, schedule of bails, and appeal bonds, is amended in subsection (a) by revising paragraphs (13) and (14) and adding a new paragraph to read as follows: "(13) Violating Code Section 16-5-46; ~~and~~

(14) Violations of Chapter 15 of Title 16; and

(15) Riot."

SECTION 3.

All laws and parts of laws in conflict with this Act are repealed.
