A RESOLUTION

Proposing an amendment to the Constitution of the State of Georgia so as to provide that revenue derived from the regulation of safe drinking water and toxic enforcement may be dedicated for certain purposes and not deposited into the general fund; to authorize the General Assembly to create the Safe Drinking Water and Toxic Enforcement Fund; to provide that such funds shall not lapse; to provide for related matters; to provide for the submission of this amendment for ratification or rejection; and for other purposes.

BE IT RESOLVED BY THE GENERAL ASSEMBLY OF GEORGIA:

SECTION 1.

Article III, Section IX of the Constitution is amended in Paragraph VI by adding a new subparagraph to read as follows:

"(s) The General Assembly may provide by general law for the creation of the Safe Drinking Water and Toxic Enforcement Fund from which funds shall be disbursed for the enforcement of laws regarding the protection of the citizens of this state from carcinogens and toxic substances in drinking water and the protection of the citizens of this state from exposure to carcinogens and toxic substances by businesses in the course of doing business. The General Assembly shall be authorized to dedicate and deposit revenues raised from specified sources to the fund and shall be authorized to appropriate other funds to the fund. Such fund and its proceeds shall not be subject to Article VII, Section III, Paragraph II; Article III, Section IX, Paragraph VI(a); or Article III, Section IX, Paragraph IV(c) of this Constitution. The General Assembly is authorized to provide by general law for any matters relating to the purpose or provisions of this subparagraph."

SECTION 2.

The above proposed amendment to the Constitution shall be published and submitted as provided in Article X, Section I, Paragraph II of the Constitution. The ballot submitting the above proposed amendment shall have written or printed thereon the following: "( ) YES Shall the Constitution of Georgia be amended so as provide that the revenue ( ) NO derived from the regulation of safe drinking water and toxic enforcement may be dedicated for certain purposes and not deposited into the general fund?" All persons desiring to vote in favor of ratifying the proposed amendment shall vote "Yes." All persons desiring to vote against ratifying the proposed amendment shall vote "No." If such amendment shall be ratified as provided in said Paragraph of the Constitution, it shall become a part of the Constitution of this state.
